Welcome to Family Charades (“the App,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your use of the App, related downloadable materials, and any services provided therein (collectively, the “Services”). By downloading or using the App, you agree to be bound by these Terms. If you do not agree, please discontinue using the Services immediately.

1. Acceptance of Terms

By installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. This app is subject to Apple’s standard EULA (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). If you do not agree to these Terms, our Privacy Policy, or Apple’s EULA, you must not use the App.

2. Eligibility

  • The App is intended for individuals aged 4+ or the age of majority in your jurisdiction.
  • By using the App, you represent and warrant that you have the legal capacity to enter into a binding agreement.

3. License & Limited Use

  1. License Grant
    • We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the App in accordance with these Terms.
  2. Restrictions
    • You may not reproduce, distribute, publicly display, or create derivative works of our Services except as expressly permitted by these Terms.
    • You shall not reverse-engineer, decompile, or otherwise attempt to extract source code from the App.

4. Printable Materials

  1. Free Printables
    • We may provide downloadable and/or printable materials (“Printables”) for your personal, non-commercial use.
  2. Prohibited Uses
    • You shall not reproduce, sell, or otherwise exploit the Printables for any commercial purpose without our prior written consent.
  3. Intellectual Property
    • All Printables remain our property (or that of our licensors). You may use them solely in connection with the App and your personal family activities.

5. Free Trial & Subscription

  1. Free Download & First Game
    • The App may be downloaded at no charge, and your first game session is free.
  2. 1-Week Free Trial
    • We offer a 1-week free trial for new subscribers. During this trial period, you will not be charged.
    • Payment will be charged to your Apple account at the end of the trial period, unless canceled at least 24 hours before the trial ends.
  3. Subscription & Renewal
    • After the free trial, the App will require a subscription to continue using premium features.
    • Your subscription automatically renews at the rate displayed in the App unless auto-renew is turned off at least 24 hours before the end of the current period.
    • You can manage or cancel your subscription in your App Store Account Settings.
  4. Billing & Cancellations
    • All billing and subscription management is handled through your Apple account.
    • If you cancel during the free trial, you will not be charged.
    • No refunds or credits are provided for partial subscription periods, unless required by applicable law.

6. User Content

  1. Custom Words & Photos
    • The App may allow you to add custom words or images for gameplay. You are solely responsible for any content you create or upload.
  2. Ownership & Responsibility
    • You represent and warrant that you own the rights to all content you upload or have permission from the rightful owner.
    • We do not claim ownership over user-generated content, but you grant us a license to use, display, and modify such content solely to operate and improve the App’s features.

7. Intellectual Property Rights

  1. Our IP
    • All trademarks, service marks, logos, and other intellectual property displayed in the App are owned by us or our licensors.
  2. No Transfer of Rights
    • Nothing in these Terms grants you any ownership or license to use our trademarks or other intellectual property except as expressly set out in these Terms.

8. Termination

  1. By You
    • You may discontinue use of the App and/or cancel your subscription at any time.
  2. By Us
    • We reserve the right to suspend or terminate your access to the Services if you violate these Terms or if your subscription fees are unpaid.
  3. Effect of Termination
    • Upon termination, all rights granted to you in these Terms will cease immediately. You may not access or use the App or any Printables thereafter.

9. Disclaimer of Warranties

  1. As Is
    • The App and Services are provided on an “as is” and “as available” basis. We make no guarantees that the App will be error-free, secure, or uninterrupted.
  2. No Warranty
    • To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

  1. Indirect Damages
    • To the extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising out of or related to your use of the App.
  2. Maximum Liability
    • In no event will our total liability exceed the amount you have paid (if any) to use the App within the 12-month period preceding the event giving rise to the claim.

11. Changes to These Terms

We may update or modify these Terms from time to time at our sole discretion. We will post the revised Terms with an updated “Last Updated” date. By continuing to use the App after changes become effective, you agree to be bound by the updated Terms.

12. Governing Law & Disputes

  • These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law provisions.
  • Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in which we are located, unless otherwise required by law.
